Disclaimer

Product: MyOPD  •  Version: [1.1]  •  Effective: 26/08/2026

This Disclaimer applies to the MyOPD website, documentation, marketing material and platform, supplied by Caresoft Systems Private Limited. Read it with the Intended Use & Clinical Safety Statement, Terms of Use and Privacy Policy. On any question of intended use or clinical safety, the Intended Use Statement prevails.

MyOPD DOES NOT PRACTISE MEDICINE. IT RECORDS WHAT THE DOCTOR DECIDES.

It performs no clinical decision support of any kind — no dose suggestion, no interaction check, no allergy warning, no diagnosis, no risk score, no abnormal-result flag.

The absence of a warning means nothing. The system has no clinical knowledge and cannot warn you.

1. General information only

Content on our website, documentation, datasheets and proposals is general information about MyOPD. We take reasonable care to keep it accurate but make no representation as to completeness, currency or suitability for your practice. Features and pricing may change. Screenshots use illustrative data — no real patient data appears in any of our material.

2. No clinical decision support

MyOPD does not: suggest a diagnosis; suggest, default or calculate a dose; check drug-drug interactions; check allergies or contraindications; warn about duplicate therapy; flag an abnormal result; check a prescription against age, weight, pregnancy or renal function; or apply any clinical rule, guideline or protocol.

Every check a prescribing system might perform must be performed by the treating doctor, using their own knowledge and their usual references.

3. Silence is not safety

This is the most important paragraph on this page.

Clinicians who have used systems with interaction checking sometimes assume — without ever articulating it — that a system would say something if a combination were dangerous. MyOPD will not.

It will print exactly what is entered, however wrong, without hesitation and without comment.

A doctor enters a drug the patient is documented as allergic to. The allergy is recorded in the patient's own file, in this system.

Nothing happens. No alert, no colour change, no confirmation dialog. The prescription prints normally.

The system stored the allergy as text. It does not read it, does not compare it to anything, and does not know what an allergy is.

4. We record what is entered

The record reflects what was typed. Wrong drug selected from an autocomplete, wrong strength, wrong patient file open, a note recorded against yesterday's visit, a decimal in the wrong place — all are stored and printed exactly as entered.

A clean, well-formatted prescription looks authoritative. That appearance is a property of the printing, not of the content.

5. The drug list is yours

  • The drug list is a data entry convenience maintained by the clinic. It is not a formulary, not a therapeutic guide, and not verified by Caresoft.
  • Any starter list we supply is a starting point only, without warranty as to completeness, currency, spelling, strength or availability.
  • A default strength or frequency stored against a drug is your shortcut, not our recommendation, and is not right for every patient.
  • A drug appearing in the list does not mean it is licensed, available, appropriate or safe for a given patient.
  • The system does not know about regulatory action. Removing withdrawn or banned drugs is the clinic's job.

Similar drug names sit next to each other in an autocomplete list. Selecting is not verifying. Confirm the drug, strength and formulation on the finished prescription before signing.

6. The printed prescription

A prescription is a legal document. MyOPD prints what is entered and validates nothing — not legality, not dose, not completeness, not appropriateness.

  • The doctor must review the printed prescription before it reaches the patient. What matters legally is the paper the patient carries.
  • The clinic configures the print format and is responsible for it containing everything the regulator requires, including registration number.
  • Schedule H, H1 and X drugs and narcotics under the NDPS Act carry additional requirements. The system does not enforce them.
  • Where electronic signature is used, the clinic is responsible for the method being lawful and the credentials not being shared.

7. Patient identity

The system does not verify identity, does not detect that two records are the same person, and does not know a value is implausible. Duplicate records occur, and similar names are common.

Confirm patient identity at every consultation using at least two identifiers, before opening a record and before issuing a prescription. The system will not warn you that the wrong file is open.

8. Not a review of care

MyOPD does not review, audit or assess the care recorded in it. It does not detect a missed diagnosis, an inappropriate treatment, an incomplete record, or a pattern that should concern anyone.

Using MyOPD is not a clinical governance control, and it is not a defence. Reports it produces describe activity, not quality.

9. Not your only record

Do not rely on MyOPD as your only copy of your patients' medical records.

Export regularly and keep your own copy. Records must be producible on demand to a court, consumer forum, medical council or lawful authority — and that obligation is yours, not ours.

10. Retention is your obligation

The clinic sets retention within the product and is responsible for setting it lawfully. Outpatient records must generally be kept for not less than three years from the last consultation, and longer where State rules, a court, a pending complaint or a paediatric patient requires it.

Statutory retention overrides a deletion request, including from a patient. Do not configure automatic deletion without advice, and never for a child's records.

11. Availability and fallback

The Platform is provided on an "as available" basis. It will be unavailable sometimes.

Every clinic must maintain a tested paper fallback — prescription pads, a manual register, a printed appointment list, and a procedure for entering records afterwards.

Never delay or refuse treatment because the system is down. A clinic that cannot function on paper for a morning has a patient safety problem, not an IT problem.

We are not liable for consequences of an interruption where a workable fallback was not maintained.

12. Messages and reminders

Delivery is not guaranteed. Messages may be delayed, blocked, filtered or fail entirely, for reasons outside our control. Do not rely on a message reaching a patient as your only means of communicating anything that matters.

A message reveals information to whoever holds that phone. Keep content minimal, verify the number belongs to the patient, and re-check contact details at each visit.

13. ABDM

Where ABDM features are enabled, sharing occurs on the patient's consent through ABDM. Once a record is shared to another facility, it is out of the clinic's control and ours — we cannot retrieve, correct or withdraw it.

ABHA is voluntary and care must never be conditioned on it. Our compliance and certification status is as stated in current published material; do not represent a certification we have not obtained.

14. Billing and financial reports

MyOPD is not an accounting system and does not maintain your books. Figures in reports are derived from what was entered and may not match your accounting records. Reconcile before relying on any figure for a return, filing or statement. Tax configuration and invoice content are the clinic's responsibility.

15. No professional advice

Nothing produced by MyOPD, and nothing in our documentation or support, constitutes medical, clinical, legal, regulatory, tax or accounting advice. Caresoft is not a medical practitioner and provides no clinical service. We cannot advise on retention periods, professional conduct obligations, telemedicine rules or your registration requirements — take your own advice.

16. Regulatory statements

Statements about the product's regulatory position, ABDM compliance status or certifications are as set out in the Intended Use Statement §15 and our current published material at the time.

The product's position as administrative software rests on it performing no clinical decision support. If any future release adds dose suggestion, interaction checking or any clinical rule, that position must be reassessed before the feature ships.

Clinics remain responsible for their own registrations, including under the Clinical Establishments Act where applicable in their State.

17. Performance claims

Figures regarding time saved, patients per hour, waiting time reduction, revenue improvement or return on investment are illustrative estimates dependent on your practice, your workflows and how you use the Platform. They are not commitments and are not relied upon by either party in entering any agreement.

18. Testimonials and roadmap

Testimonials reflect particular experiences and do not guarantee comparable results. Roadmap items are forward-looking and may change or be withdrawn — do not purchase in reliance on functionality not yet available, and if something is material, record it as a condition in your Order.

19. Security representations

We maintain the measures described in the Privacy Policy and DPA, but no system is completely secure and we do not warrant freedom from vulnerabilities or unauthorised access. Your premises, devices, network, screen privacy and user access hygiene are your responsibility. Certifications referenced are held by Caresoft Systems Private Limited within a defined scope.

20. Disclaimer of warranties

EXCEPT AS EXPRESSLY STATED IN THE TERMS OF USE, THE PLATFORM AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY AND NON-INFRINGEMENT.

WE GIVE NO CLINICAL WARRANTY OF ANY KIND. WE DO NOT WARRANT THAT ANY RECORD, PRESCRIPTION, MASTER, DEFAULT OR REPORT IS CLINICALLY CORRECT, COMPLETE OR APPROPRIATE; THAT ANY MESSAGE WILL BE DELIVERED; THAT IMPORTED OR ENTERED DATA IS ACCURATE; OR THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE.

21. Limitation of liability

OUR LIABILITY IS LIMITED AS SET OUT IN TERMS OF USE §25, INCLUDING THE EXCLUSION OF INDIRECT AND CONSEQUENTIAL LOSS AND THE CAP AT FEES PAID IN THE PRECEDING [TWELVE (12)] MONTHS.

IN PARTICULAR, WE ARE NOT LIABLE FOR: ANY CLINICAL DECISION, DIAGNOSIS, PRESCRIPTION OR ADVICE; THE CONTENT OF ANY RECORD OR PRESCRIPTION; THE CONTENTS OF YOUR MASTERS OR ANY DEFAULT STORED IN THEM; ANY HARM ARISING FROM THE ABSENCE OF A WARNING THE PLATFORM NEVER CLAIMED TO PROVIDE; A MESSAGE NOT DELIVERED; CONSEQUENCES OF AN INTERRUPTION WHERE NO WORKABLE FALLBACK WAS MAINTAINED; ERRORS IN DATA YOU ENTERED OR IMPORTED; OR ANY BREACH BY YOU OF A PROFESSIONAL OR STATUTORY OBLIGATION.

Nothing here limits liability for fraud, death or personal injury caused by negligence, or any liability that cannot lawfully be limited.

22. Governing law and contact

Governed by the laws of India and subject to the dispute resolution provisions in Terms of Use §28.
